CLOEM (“CLOEM” or “CLOEM S.A.S.U.” or “cloem.com” or “website” or “we” or “us”) offers access to a variety of services, including the publication of patent claims and variants thereof, called cloems™, as well as other services and publications (“Services” or “Content” or “cloems”). Read our Terms of Service.
1. COLLECTED INFORMATION
In general, you can visit CLOEM on the Internet without telling us who you are and without providing any personal information. There are times, however, when we or our partners may need information from you. By providing this information you are giving us explicit consent to use your personal information in the ways described below. We collect information in two ways:
1.1 Information you give us.
Some of our services require you to sign up for a CLOEM Account. Cloem just handles the very basic customer information and contact details which are required to conduct business with you (e.g. name, address, email).
You are responsible for the accuracy of the data that you provide to us and for all subsequent consequences, including possible loss of rights if incorrect data is entered. For example, if you are using pseudonyms or fake names during registration or payment, we cannot be held responsible of possible loss of rights regarding grace periods provisions related to patent rights if applicable in your jurisdiction. We do not check or verify the accuracy or correctness of the data you provide to us. We will not warn you or ask you to check the submitted data. You are free to enter fake data, for example to remain anonymous, but we do then strongly warn you regarding the possible loss of possible associated rights. It is generally your interest (and the general public's interest) to remain transparent.
Bank account and payment details like bank account numbers remain unknown to us as they are only visible by the payment platform e.g. Paypal. Except the amounts paid, we have no idea of your banking details and a fortiori we do not store them.
1.2 Information we get from your use of our services.
We may collect information about the services that you use and how you use them, like when you view and interact with our Services and Content.
When you use our services or view content provided by CLOEM, we TEMPORARILY collect certain information in server logs. This may include:
a) details of how you used our service, such as your search queries, date and time you accessed or left the site, which Content (for example cloems) you accessed or which pages you viewed
b) Internet Protocol address
c) device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL.
In more details:
- Device information. We may collect device-specific information (such as your hardware model, operating system version, unique device identifiers, etc).
- Connection and access logs information. We do not track you personally. We use Piwik for web traffic analysis purposes.
- Search queries. Your search queries are received by us. These search queries are encrypted and we do not store logs online.
- Local storage. We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches.
2. USE OF INFORMATION
We use the information we collect from all of our services to provide, maintain, protect and improve them, to develop new ones, and to protect CLOEM and our users.
We also use this information to provide you with access to cloems.
You may want to give us information, such as your name and address or e-mail, to correspond with you, to process an order, or to provide you with a subscription to our services. We may use personal information that is coupled with general information and performance data to improve your experience on our site by providing you with information that is relevant to you. We may also use personal information we collect to provide you with information about other products or services offered by CLOEM. If you do not wish to receive these kinds of communications, you can opt out by using the unsubscribe options in emails. Please allow a reasonable amount of time for us to process your request. We collect device information to ensure that content from our site is presented in the most effective manner for you and for your computer. We collect information to provide you with information, products or services that you request from us and which are described on our site.
We may create de-identified information – that is, information about you that has been combined with information about others who use the site, with general information and with performance data – for a broad range of purposes. All personal information about you and about other users has been removed from this de-identified information before we use it for any purpose. We may use this de-identified information (aggregated, non-personally identifiable information) to assist in the development of new programs and services; to keep you informed and up to date about us; to determine characteristics of visitors to our website; to help us serve our customers in the most useful way possible; and/or to help to market CLOEM. We may use any of this de-identified data in presentations, research and other related materials; in aggregate form to analyze trends; and to monitor and analyze site traffic and usage patterns and to improve the Content, content delivery and cloems.
We may use the name you provide for your CLOEM Account across all of the services we offer that require a CLOEM Account. In particular, - if and only if you do select the corresponding option when purchasing one of our product or service -, we may publish your name and/or contact details along one or more of your cloems.
When you contact CLOEM, we may keep a record of your communication to help solve any issues you might be facing. We may use your email address to inform you about our services, such as letting you know about upcoming changes or improvements.
CLOEM processes personal information on our servers in several countries around the world. Our servers are currently in France. We may then process your personal information on a server located outside the country where you live.
Your search queries are (tentatively) protected with the highest standard available today, namely the SSL Extended Validation encryption. We advise you to pay attention to the security of your end computing device (SSL does not protect against interception at a compromised end device). We do not store online - other than temporarily for one day - your search queries to our website. Your search queries do not bar us from independently creating contents. We may indeed independently get these words from other clients than you or from other sources.
3. SHARE OF INFORMATION
We do NOT share personal information (nor log information) with companies, organizations and individuals outside of CLOEM unless one of the following circumstances apply:
a) we have your permission;
b) we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets; or
c) we are under a duty to disclose or share your personal data in order to comply with any legal obligation or in order to enforce or apply our Terms of Service. We will share personal information with companies, organizations or individuals outside of CLOEM if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to: meet any applicable law, regulation, legal process or enforceable governmental request; enforce applicable Terms of Service, including investigation of potential violations; detect, prevent, or otherwise address fraud, security or technical issues; protect against harm to the rights, property or safety of CLOEM, our users or the public as required or permitted by law.
We may share aggregated, non-personally identifiable information publicly and with our partners. For example, we may share information publicly to show trends about the use of our services.
Transparency and choice
Our goal is to be clear about what information we collect, so that you can make meaningful choices about how it is used. For example you can review and control certain types of information tied to your CLOEM Account. You can or will be able to view and edit your preferences, for example you can opt out of certain CLOEM advertising services.
Information you share
Please remember that when you share information publicly, it may be index-able by search engines, including CLOEM.
Accessing and updating your personal information
Whenever you use our services, we aim to provide you with access to your personal information. If that information is wrong, we strive to give you ways to update it quickly or to delete it – unless we have to keep that information for legitimate business or legal purposes. When updating your personal information, we may ask you to verify your identity before we can act on your request.
We may reject requests that are unreasonably repetitive, require disproportionate technical effort (for example, developing a new system or fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes).
Where we can provide information access and correction, we will do so for free, except where it would require a disproportionate effort. We aim to maintain our services in a manner that protects information from accidental or malicious destruction. Because of this, after you delete information from our services, we may not immediately delete residual copies from our active servers and may not remove information from our backup systems.
We work very hard to protect CLOEM and our users from unauthorized access to or unauthorized alteration, use, disclosure or destruction of information we hold. In particular:
- we encrypt many of our services using SSL
- we review our information collection, storage and processing practices, including physical security measures, to guard against unauthorized access to systems
- we restrict access to personal information to CLOEM employees, contractors and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations
- we have put in place suitable and commercially reasonable physical, electronic and administrative procedures to safeguard and secure the information we collect online. While we will take all reasonable steps to protect your personal information, no set of security safeguards is guaranteed to be impenetrable. We cannot and do not guarantee the security of any personal information you disclose online. You accept the inherent security implications of dealing online and will not hold us responsible for any breach of security.
